Present petition has been filed under Article 226 of theConstitution of India for directing respondents no.1 to 3 to protect the lifeand liberty of the petitioners from the hands of respondent no.4.
Learned counsel for the petitioners states that both thepetitioners are living in live-in-relationship against the wishes ofrespondent no.4 and have sought protection to their life and liberty. Hehas submitted that although the petitioner No.2 is 17 years of age yet sheis entitled for protection. Both the petitioners apprehend danger tromrespondent no.4. The petitioners have submitted a representation dated24.12.2022 (Annexure P-3) to respondent no.2.
Notice of motion to respondents no.1| to 3-State only.
On the asking of the Court, Mr. Vishnav Gandhi, DAG, Punjab accepts notice on behalf of the State.
Without entering upon an exercise to evaluate the evidentiary value of the documents placed on the file, I dispose of the petition with adirection to respondent no.2-Senior Superintendent of Police, Tarn Taranto decide the representation (Annexure P-3) of the petitioners and grant CRWP-12306-2022
them protection, if any threat to their life and liberty is perceived. It isclarified that this order shall not be taken to grant immunity to thepetitioners from legal action for violation of law, if any, committed bythem. This order would not be understood having expressed any opinionwhatsoever by this Court on the validity of the live-in-relationship of thepetitioners. —
