LPASW No. 238/2017, MP No. 1/2017

Prenika Thakur

vs State of J&K and ors

Coram:

Hon’ble Mr Justice Badar Durrez Ahmed, Chief Justice Hon’ble Mr Justice Sanjeev Kumar, Judge.

Appearance: For the Appellant(s) : Mr Anil Khajuria, Advocate. For the Respondent(s): Mr Ravinder Gupta, AAG. i) Whether approved for reporting in Yes/No Law journals etc.: ii) Whether approved for publication in press: Yes/No The present appeal is filed against the order dated 16.11.2017, passed by the learned Single Judge of this Court in SWP No. 455/2011. The only direction given by the writ court is that the respondents shall consider the grievance of the petitioner in accordance with law as applicable in the facts and circumstances of the case by passing a speaking order as expeditiously as possible, preferably within a period of six weeks from the date of receipt of copy of this order.

We do not see how the appellant, who was respondent in the writ petition is aggrieved of this case because this order does not prejudice to the respondent at all. Accordingly, the appeal is dismissed.

In this view of the matter the learned counsel for the appellant seeks permission to withdraw this appeal.

The appeal is dismissed as withdrawn.
