It appears that fake medical certificate was filed on basis of which this Court taking the same to be genuine passed certain orders. On coming to know of aforesaid misrepresentation, this court directed the CBI to take up investigation of the matter.

The CBI as such instituted RC case no. 45 of 2002 and submitted charge sheet after investigation. Subsequently cognizance was taken against the petitioner and charge was also framed against him. Trial too ended in his conviction under sections 120B, 420,466 I.P.C. The maximum punishment accorded to the petitioner was 1 year and 3

months, besides fine. It was further directed that all the sentences would run concurrently. The petitioner also deposited the fine.

It view of the report dated 25.2.2010 mentioning that the petitioner has subsequently died, the matter is dropped against him. So far other accused persons are concerned, I have not made any opinion regarding proceeding pending against them.

Registry is to see that records of these cases be kept in safe custody, as ordered earlier.
