01. After arguing for a while, learned counsel for the petitioner seeks withdrawal of the present petition to avail the efficacious remedy provided under the Statute, i.e. the Central Administrative Tribunal, which has the jurisdiction to adjudicate the present issue in question.
02. Learned counsel further submits that he will file an OA before the CAT within a week’s time positively and seeks protection from this court till filing of the same before the CAT.
03. In view of the submissions made at bar, the instant writ petition is dismissed as withdrawn with the liberty to the petitioner to avail the efficacious remedy available to him under law and the fate of the petitioner will be governed by the decision so made by the concerned forum. However, till one week’s time from today, it is directed that no coercive measures shall be initiated against the petitioner on the basis of the impugned demand notice dated 23[rd] December 2022 and in view of the urgency so projected, the OA, so filed, by the petitioner shall be immediately decided after its filing.
