It appears that the learned counsel who was appearing on behalf of the sole appellant submitted that he is not interested to appear further in this Appeal, and, therefore, his presence was ignored and by terms of order dated 17.07.2009, notice was issued by the Court to the sole appellant for engaging another Advocate in this Appeal. The process Server has reported that the sole appellant has died as far back as in the year 1992. The report is at flag ‘76’.

In view of above report of the Process Server, this Appeal has abated.

Accordingly, this Appeal is dismissed as a whole.
