HIGH COURT OF JAMMU AND KASHMIRAT JAMMU

HCP No. 56/2018 IA No. 1/2018

Date of order: 31.12.2018

Rama Devi Vs Pritam Chand and ors.

Coram:

HON’BLE MR. JUSTICE DHIRAJ SINGH THAKUR, JUDGE.

Appearance:

For the petitioner (s) : Ms. Pooja Uppal, Adv. For the respondent(s) : Mr. C.M. Koul, Sr. AAG. (Oral)

Pursuant to direction dated 26.12.2018 passed by this Court, the girl, namely, Rama Devi has been produced before the Court. She made a statement that she has married one Rajesh Kumar S/o Munshi Ram in the year 2013 but on account of interference of her parents, she was illegally being prevented from remaining in the company of her husband. It is stated by her that she was born on 27.03.1989 and is a graduate with B.Ed. qualification and is entitled to take her own decisions in life.

The parents of Rama Devi are also present in person in the Court. They humbly submitted that they were not happy with the decision of their daughter in marrying the afore-stated person on account the fact that she is highly qualified.

The fact that the petitioner is highly qualified and understands the decisions she makes for herself, is more important in the facts and circumstances of this case. The petitioner, thus, cannot be prevented from remaining the company of her husband, Rajesh Kumar any further.

Be that as it may, this petition along with connected IA is disposed of with a direction to the official respondents to ensure that petitioner is not prevented, in any manner, from being in the company of her husband, Rajesh Kumar. Strict action in accordance with law be taken against any body who violates any such right vested in the petitioner.

Mr. Rajesh Khajuria, Station House Officer, who is present in the Court is directed to ensure the safe passage of the petitioner to the house of her husband.

(DHIRAJ SINGH THAKUR) JUDGE
