SPECIAL CRIMINAL APPLICATION No 1551 of 1996

For Approval and Signature:

Hon'ble THE CHIEF JUSTICE G.D.KAMAT

============================================================ -------------------------------------------------------------- ARJUNSINGH PARVATBHAI PATELIYAVersus STATE OF GUJARAT -------------------------------------------------------------- Appearance: MS SUBHADRA G PATEL for Petitioner Mr.M.R. Anand, PUBLIC PROSECUTOR, with Mr.L.R. Pujari, APP, for Respondent No. 1

-------------------------------------------------------------- CORAM : THE CHIEF JUSTICE G.D.KAMAT Date of decision: 02/12/96

ORAL JUDGEMENT

Rule. By consent, to be heard forthwith.

The applicant is convicted for offences punishable under Section 302 of the Indian Penal Code and sentenced to life imprisonment by the Additional Sessions Judge, Godhra on 30th July, 1994. Invoking the Prisons (Bombay Furlough and Parole) Rules, 1959,he applied for his release on furlough on 1st of June, 1996, but the Inspector General of Prisons has not decided his application. This exactly is the grievance of the petitioner in the present petition. I find no difficulty in directing the respondents, more particularly respondent No.3, to decide the application of the petitioner for furlough within 15 days from today. Rule is accordingly made absolute. ********
