====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMARORAL ORDER

3 04-02-2013 The present writ petition was filed, of-course, long back in the year 2006 assailing the order dated 10.12.2005 passed in Land Ceiling Revision Case No. 42 of 2004 by Member, Board of Revenue.

In this case, no counter affidavit has been filed till date. However, during the pendency of the present writ petition, a Forum for redressal of such dispute has already been created under the provisions of Bihar Land Tribunal Act, 2009, and Land Tribunal is already functioning. In that view of the matter the Court is of the opinion that this writ petition can be directed to be referred to the Tribunal for its adjudication in terms of provision contained under Section 15 of the Act. This Court directs the Registry to transfer the record to the Tribunal forthwith.
