IN THE HIGH COURT OF JUDICATURE AT PATNA S.A. No.681 of 1986 RAGHU NANDAN PRASAD Versus TULSI YADAV & ORS. ----------- 16/ 08.09.2009

Learned counsel for appellant submits that from the seal of the office on the first page of memorandum of second appeal, it is quite apparent that this second appeal has been filed on 28.10.1986.

It transpires that first page (title) of the order sheet of the second appeal was lost and there was no vital order on that part of the order sheet except the date of filing of the second appeal, whereafter all the necessary orders of the court are on record in the remaining pages of the order sheet. The first page of the order sheet cannot be retrieved and the instant second appeal has already been disposed of on 28.09.2001. In the said circumstances, the record room is directed to accept if the file of the instant second appeal is deposited before it.
