Though the Court is not satisfied with the reason providedfor non-appearance, however, in the interest of the litigants, therestoration application is allowed.
C.W.J.C. No. 16201 of 2013 is restored to its original file.

The writ application is taken up and heard on merits.

Since the State Government has taken a conscious decisionthat no new schools are going to be taken over under the BiharNon-Government Elementary School (Taking Over of Control)Act, 1976, as a matter of policy, so long as that policy is invogue and is in existence, there cannot be a mandamus fortaking over the school in question.
Attention of this Court was also drawn to an order dated Pawan/- U
26.07.1989 passed in C.W.J.C. No. 2768 of 1989, a copy of theorder is Annexure-8. Even in the said order, the Division Bench expressed its inability to give a direction for taking over.
Writ has no merit. It is dismissed.
