... ... PetitionerVersus

The State of Bihar

Heard learned counsel for the petitioner and the State via Video Conferencing.

Petitioner apprehends arrest in Aurai (Muzaffarpur)Police Station Case No.253/2019 registered for the offencespunishable under Section 7 of the EC Act.

On the secret information, authorities raided thevillage house of the petitioner and recovered 87 bags of wheatand 101 bags of rice kept for the purpose of black marketing.

Learned counsel for the petitioner submits that thepetitioner has falsely been implicated in this case due to politicalrivalry and being a PDS dealer, she had kept food grains in theaforesaid godown for its convenient distribution amongst thebeneficiaries. None of the beneficiaries has made any complaintagainst the petitioner. It is also submitted that no incriminating Shashi UT

material has come against the petitioner. Petitioner has got nocriminal antecedent.

Learned counsel for the State opposes the prayer forbail submitting that the food grains had been kept by thepetitioner in an unauthorized godown at her village for blackmarketing.

Considering the gravity of the allegation against thepetitioner, her prayer for bail is refused with direction tosurrender and seek regular bail which would be considered anddisposed of on its own merit without prejudice.
