IN THE HIGH COURT OF JUDICATURE AT PATNA

Cr.Misc. No.25756 of 2008

BOUKU MANDAL

Versus

STATE OF BIHAR

-----------

4. 23.12.2008

Heard Mr. B. K. Singh, learned counsel for the petitioner and Mr. D. Mehta, learned A.P.P.

The report from Superintendent of Police, Naugachia, has been received and that is at flag-‘X’. According to it, the petitioner is an accused in as many as five cases of the present nature including the present case. The case relates to soliciting investment in the name of one Shiv Gauri Yuwa Samiti, Bhawanipur, from different investors including the complainant. It is indicated that the complainant deposited a sum of Rs.40,625/- only and he learnt about the credentials of the above noted Financial Institution which was subsequently known as Goonda Bank. He rushed for getting back his invested money but failed. As such, the complainant has filed the complaint petition.

In the light of the activities in which the petitioner appears indulging so frequently and considering the fact that the innocent persons of the rural areas have been duped and defrauded by the petitioner and thereby deprived them of their money, I am not inclined to direct release of the petitioner on bail.

The petition is dismissed.
