The present petition has been taken up for consideration through the mode of Video conferencing in viewof the prevailing situation on account of COVID 19 Pandemic,requiring social distancing.

Heard learned counsel for the petitioner and learnedAPP for the State.

Petitioner seeks bail in connection with Laukahi P.S.Case no. 151 of 2021 registered for the offence punishableunder sections 272, 273/34 of the Indian Penal Code read withsection 30(a) of Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that thepetitioner is in custody since 12.7.2021, is person with cleanantecedent and charge sheet has been submitted. Allegation isrecovery of 450 liters of liquor near Nepal border and 27 liters s.hassan/- UT

of liquor was recovered from possession of the petitioner.Learned counsel submits that petitioner was coming from Nepalas such based on suspicion, he was implicated in the presentcase.

Learned APP opposes the prayer for bail.

Considering the facts that petitioner is in jail custody,is person with clean antecedent and charge sheet has beensubmitted, petitioner is directed to be released on bail onfurnishing bail bonds of Rs 5,000/- (five thousand) with twosureties of the like amount each to the satisfaction of the ADJ II-cum- Special Judge, Excise Act, Madhubani in Laukahi P.S.Case no. 151 of 2021.
