CORAM: HONOURABLE MR. JUSTICE V.N. SINHAORAL ORDER

4 24-12-2013

Heard learned counsels for the petitioner and the State.

Petitioner is apprehending his arrest in connection with a case registered for the offences under Sections 420, 467, 468 and other allied sections of the Indian Penal Code on the allegation that he duped the informant and obtained sale deed for an area larger than the area which was agreed to be sold by the informant and consideration paid by the petitioner. The sale deed having been registered with the consent of both the vendor and the vendee and execution having been admitted by the vendor in presence of the Registrar, I find no reason to disbelieve the contents of the sale deed.

Learned counsel for the informant however submits that the prayer for bail in the event of arrest filed on behalf of the petitioner should be rejected. Chargesheet has been submitted indicating him as absconder. Petitioner is a railway servant serving at Bilaspur in the State of Chhatisgarh and no material is placed on the record to indicate that any notice for appearance by the petitioner in the present criminal case was ever served on him by the investigating officer.

Let, petitioner above named surrender in the court below within a period of four weeks from the date of receipt/production of a copy of this order and be admitted to the privilege of bail on furnishing bail bond of Rs. 5,000/- (Five thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate, Hilsa, in connection with Parbalpur P.S. Case no. 14 of 2013.
