CORAM: HONOURABLE MR. JUSTICE SAMARENDRA PRATAP SINGHORAL ORDER

2 22-12-2015 Heard the petitioner, State and the complainant.

The petitioner apprehends his arrest in a case under sections 406, 420 and other allied sections of the Indian Penal Code on the allegation that being controller of NGO, namely, Jan Vikash Swayamsevi Sansthan, Maharajganj, Madhubani, opened with an objective to ensure life of the poor persons, took informant’s premium amount of Rs.3,50,000/- and did not open life insurance policy with the LIC.

The petitioner submits that the allegation is false as not a single consumer has made such complaint against him so far and the informant has not produced any document in support of his contention that he deposited money with the NGO, and there is likelihood of his money being usurped by some agent. He further submits that no amount has been paid by the informant after 2008.

Counsel for the complainant controverts petitioner’s submission and states that the petitioner grabbed the amount and did not create any life insurance policy.

In my view, the petitioner should surrender and pray for regular bail, which would be disposed of preferably on the same day on its own merit without prejudice, also taking into consideration that the informant has not produced any document in support of his contention that any amount has been paid by him after 2008 with petitioner.

The bail petition is thus disposed of.

Shashi.
