By the Court :

Heard learned counsel for the parties.

The petitioner has preferred this contempt petition for the disobedience of the order of this Court dated 27.09.2001 passed in S.B. Civil Writ Petition No.4709 of 2001.

Although, there is

no specific direction by this Court, which can be said to have beenviolated by the respondents, but according to the petitioner, therespondent no.1 has passed an order on 10.10.2001, which is said tobe contrary to the order dated 27.09.2001 passed by this Court.

Learned counsel for the petitioner is unable to refer anydocument to show that the Collector had knowledge about the orderdated 27.09.2001 before passing the order dated 10.10.2001.

Apart from above, the learned counsel for the respondenthas pointed out that the respondent has not touched the land of thepetitioner, and his land has not been included in the order dated10.10.2001, therefore, no contempt is made out in the facts andcircumstances of the present case. A copy of `jamabandi' of thedisputed land of the petitioner showing the name of the petitionerhas also been placed on the record. No rejoinder to this reply hasbeen filed by the petitioner. In view of above, I do not find anydisobedience of the order of this Court.

The contempt petition is accordingly dismissed. The notices of contempt stand discharged.
