ORDER
31.12.2022
Petitioners contention is that they were promoted as Meter –Readers in the Power Development Department and they were entitled to the pay scale attached to the said post, but they have not been granted the said pay sale and grade attached to the post of Meter Readers (Executive Cadre), though this is being granted to the similarly situated persons. The petitioners stated that the said issue has already been settled in the writ petition bearing No. SWP no. 2455/2011 and in SWP no. 1922/2018.
Learned counsel for the petitioners states that petitioners would feel satisfied, if the writ petition is disposed of by directing the respondents to accord consideration to the petitioners case in light of averments made in the petition and judgment dated 26.02.2008, rendered in SQWP no. 2455.2001 titled Subhash Chander and others vs. State of JK and others, read with judgment dated 27.07.2009 in DCLSW no. 56/2008 clubbed with LPA (SW) 142/2008 and SWP no. 1922/2018.
In view of the statement of learned counsel for the petitioners, this petition is disposed of with a direction to the respondents to accord consideration to the case of the petitioners in view of the averment made in the petition and in the light judgment in SWP no. 2455/2001, DCLSW No. 56/2008 clubbed with LPA(SW) 142/2008 and SWP no. 1922/2018, provided their case is covered by the above said judgments within a period of eight weeks from the date copy of this order along with writ petition is served on respondents.
Disposed of as above along with connected CM
