TrP (C)/30/2019 of TSEWANG DOLMA AND ANR. Vs SONAM RINCHIN AND ORS. on 31 December 2019

ORDER

01. This application has been filed seeking transfer of OWP No. 1872/2018 titled ‘Sonam, Rinchin vs. State of J&K and others’,from the Srinagar Wing of this High Court to Jammu Wing. 02.Given the fact that the video conferencing facilities are available and the applicants in this transfer application can be represented by a counsel from Jammu Wing in the proceedings in OWP No. 1872/2018, learned counsel for the applicants submits that he does not press this transfer application and a prayer is made that this application be treated as an application for a request seeking participation in the writ proceedings on Video conference.

03. The submission made by the learned counsel for the applicants is fair and deserves to be accepted.

04. In view thereof it is directed as follows:

i)This transfer petition is dismissed as withdrawn.

ii) It is directed that the applicants shall be permitted to be represented in the proceedings in OWP No. 1872/2018 on a video link from this Court.

05. Let a copy of this order be communicated to the Registrar Judicial, Srinagar Wing by the Registrar Judicial of this Wing.

06. It is made clear that nothing herein contained is an expression of opinion on the merits of the case.

07. The applicants herein is granted leave to file reply, if not already filed, in OWP No. 1872/2018 within four weeks from today.

08. Liberty is given to the learned counsel for the applicants to send his objections, if not already filed, by registered AD covers to the Registrar Judicial Srinagar.

09. OWP No. 1872/2018 shall be listed for directions before the learned Single Judge in the Srinagar Wing of the High Court.

10. The Registrar Judicial (Srinagar) shall arrange for the matter to be heard on video conference.

11. This transfer application and pending application is disposed of with the above directions.
