ORAL JUDGEMENT

Learned advocate Mr Gaurang Bhatt appearing for the petitioner has submitted that this revision application has become infructuous for the reason that Regular Civil Suit No. 15 of 1990 filed by the petitioner-plaintiff in the Court of Civil Judge (Junior Division), Sayala, District Surendranagar was decreed on 20th June, 1996.

He has submitted that the present revision application has been filed for challenging an order dated 19th December, 1990 passed in Civil Misc. Appeal No. 44/90 by the Joint District Judge, Surendranagar whereby an order passed below Exh. 5 in the above referred suit was set aside.

As stated hereinabove, the suit has already been decreed and, therefore, this revision application has become infructuous. This revision application is, therefore, dimissed. Rule is discharged.

Ad-interim relief granted earlier is vacated.
