ORDER
Order No.
05. 10.09.2026
(Through hybrid Mode)
1. On 08.09.2026, when the matter was taken up, no counsel appeared on behalf of the Parties for which, the matter had been adjourned to 09.09.2026. The matter could not be taken up on 09.09.2026 and was adjourned to today.
2. Today when the matter is called, no counsel appears on behalf of the Petitioner but Mr. Gourav Das, learned counsel is present on behalf of Mr. Niranjan Lenka, learned counsel for the
Opposite Parties No.1 to 4. But he submits that he is unaware about the present status of the Civil Suit.
3. To grant an opportunity to the learned counsel for the Petitioners, in the interest of justice, the matter is passed over to be taken up after recess. Later
4. No counsel appears on behalf of the Petitioners.
5. This CMP has been filed with the following prayer:- “set aside the impugned order dated 14.03.2016 passed in Civil Suit No. 20/ 2008 passed by the learned Civil Judge (Junior Division), Kendrapara rejecting to ‘impaled’ some persons as Defendants No.5 and 6 vide Annexure-4.”
6. Although the prayer is indecipherable, on perusal of Annexure-4, it is apparent that the petition filed on behalf of the Plaintiffs under Order 6, Rule 17 of the CPC read with Order 1, Rule 10 of the CPC to amend the plaint has been rejected and this order has been challenged.
7. While issuing notice on 21.02.2017, this Court had been stayed further proceeding in Civil Suit No. 20 of 2008.
8. Thereafter the matter was listed on 08.09.2026.
9. The CMP is of the year 2016. More than ten years have elapsed since the interim order was passed and in view of the decision of the judgment of the Supreme Court in the case of Asian Resurfacing of Road Agency Pvt. Ltd. & Another Vrs. Central Bureau of Investigation: (2018) 16 SCC 299, it can safely be presumed that the suit has been disposed of in the meanwhile or proceeded substantially for which I am not inclined to keep the CMP pending.
10. The CMP is dismissed.
11. Interim order passed earlier stands vacated.
12. Misc. Case No. 2050 of 2016 stands disposed of.
